Terms of Service

1. Service Description

Kilo provides an AI-powered sales qualification chat widget that you embed on your website. The service includes: AI conversation with visitors, qualification scoring using sales frameworks (MEDDPICC, BANT, SPICED), Slack notifications, CRM integrations, and a dashboard to manage leads and conversations.

2. Account & Access

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials. One account maps to one organization, which can manage multiple sites.

3. Acceptable Use

You agree to use Kilo only for lawful business purposes. You may not:

• Use the service to collect data from visitors without appropriate legal basis
• Attempt to extract or reverse-engineer the AI models
• Use the service for spam, harassment, or deceptive practices
• Resell the service without written agreement
• Exceed your plan's conversation limits through artificial means

4. Your Content & Data

You retain ownership of all content you provide to Kilo, including product context, indexed documentation, and site configuration. You grant Kilo a license to process this content solely to provide the service.

Conversation data generated by visitors on your site is processed by Kilo on your behalf. You are the data controller for your visitors' data.

5. AI-Generated Content

Kilo's AI agent generates responses based on the context you provide. While we strive for accuracy, AI responses may occasionally be incorrect or incomplete. You are responsible for the accuracy of the product context you provide. Kilo is not liable for business decisions made based on AI-generated qualification scores or conversation summaries.

6. Plans & Billing

Kilo offers tiered subscription plans billed monthly. Plan limits (conversations, sites) are enforced automatically. Overages are not charged — conversations beyond your limit are paused until the next billing cycle. You may upgrade or downgrade at any time; changes take effect at the next billing cycle.

7. Free Trial

New accounts receive a 14-day free trial with access to Starter plan features. No credit card is required. At the end of the trial, you must select a paid plan to continue using the service.

8. Cancellation & Data Deletion

You may cancel your subscription at any time from your Account settings. Upon cancellation, your account remains accessible until the end of the current billing period. You may request complete data deletion at any time — all data (conversations, sites, indexed content) will be permanently deleted within 30 days.

9. Service Availability

We aim for 99.9% uptime for the chat widget and API. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by third-party services (Anthropic, Supabase, hosting providers).

10. Limitation of Liability

Kilo's total liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or missed sales opportunities.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States.
